This Agreement also includes a mandatory arbitration provision requiring disputes to be resolved through individual arbitration rather than jury trials, court proceedings, or class actions.

Your consent is not a condition of purchase. Authorized Members or third parties may also send these communications on behalf of AXIS REFERRAL.

We may update this Communication Policy at any time. Any changes will take effect immediately upon posting, and the “Last Updated” date will reflect the latest revision. You waive the right to receive individual notice of these updates. Your continued use of our Site or services constitutes acceptance of any changes.

The AXIS REFERRAL communication service is provided on an “as is” basis. It may not be available in all locations, across all carriers, or at all times, and may cease to function due to carrier, coverage, or technical changes. AXIS REFERRAL reserves the right to discontinue or modify any communication program at any time without notice or liability. Neither AXIS REFERRAL nor its employees or partners shall be liable for any losses arising from communication delays, failures, or technical errors. Carriers are not responsible for delayed or undelivered messages.

AXIS REFERRAL or its vendors may send you SMS (Short Message Service) or MMS (Multimedia Message Service) alerts related to your inquiries, referrals, or service requests. To enroll, you must provide a valid mobile number. By enrolling, you consent to receive recurring messages to that number. Message frequency may vary. AXIS REFERRAL does not charge a fee for these messages, but your carrier’s standard message and data rates may apply.

To stop receiving text alerts, reply with “STOP” to any AXIS REFERRAL message. After unsubscribing, you may receive a final confirmation message before communications cease. You can re-enroll at any time by signing up again.

The type of consent required depends on the nature of the communication—Conversational, Informational, or Promotional—and whether it is transactional or marketing-related.

Conversational messages involve two-way, real-time interactions with existing clients or known contacts and imply consent when the customer initiates the exchange.

Informational messages provide updates or important service-related information. These require express permission, which may be given through opt-in forms, verbal consent, website registration, or written authorization.

Promotional messages are used for marketing and sales communications and also require express opt-in consent, which may be collected via form, checkbox, or text confirmation.

“Calls-to-Action” (CTAs) within text messages may include links prompting the recipient to take an action—such as making a payment, confirming opt-in status, or visiting a property listing or booking calendar.

AXIS REFERRAL may send text messages containing information about available real estate services, updates, and promotional offers. Clients can opt out by replying with “STOP” or “UNSUBSCRIBE.” Message frequency depends on user engagement. Promotional messages are sent only to contacts who have opted in via AXIS REFERRAL’s website or partner advertising channels.

AXIS REFERRAL maintains a call recording system used for lawful purposes such as training, compliance, quality assurance, and security. All incoming and outgoing calls may be monitored and recorded. Recordings are accessed only when necessary and by authorized personnel, such as senior management, legal representatives, or IT administrators. Data from these recordings will be handled in compliance with applicable privacy laws, including GDPR, and securely stored, used only for the intended purpose, and deleted when no longer necessary.

Whenever feasible, participants will be informed that a call may be recorded. Continuing the call constitutes consent to recording for the stated purposes.

If you use our Site or mobile app, we may access certain public information from your connected social accounts (e.g., Facebook, Google, Instagram, Pinterest, Twitter, WhatsApp). This may include your name, email, profile photo, and location. You control which permissions you grant.

Disputes arising from or related to this policy will be resolved through arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. By agreeing to this policy, you waive the right to a jury trial or participation in class actions. The arbitrator’s decision will be final and binding.

If any part of this Dispute Resolution section is found invalid, the remaining terms will still apply. However, if the class action waiver is deemed unenforceable, the entire arbitration clause becomes void, while the rest of this Agreement remains effective.
